Effective Date: July 31, 2022.  By participating or continuing to participate in the CarCard Rewards and Benefits (Program), you agree to the terms and conditions that govern the program and it is your responsibility to read and understand them.  Should you require further clarification; you may contact CarCard Customer Care at rewards@carcard.com. 

General 

  1. The AutoMax Rewards and CarCard Benefits offered in connection with your CarCard Prepaid Visa Debit Card collectively include; Discounts, AutoMax Rewards, and Extended Limited Warranty Coverage, are offered at the sole discretion of MEI Finance, Inc. and/or VBI Financial Services, LLC.  Availability of all or part of the CarCard Program benefits may require your continued participation in financial services offered through MEI Finance, Inc and the CarCard Visa Prepaid Card and your continued performance to maintain your Card account and MEI Finance Auto Loan in Good Standing.     
  2. CarCard Rewards and Benefits are governed by and to be construed under the laws of the State of Texas, without giving effect to or that would cause the application of any other state laws.  Cardholder consents that any claims may not be resolved though any class action and agrees that the venue for all suits will be in Tarrant County, Texas.   The Terms and Conditions set forth herein supersede all prior Program Terms and Conditions. 
  3. Arbitration: Disputes over this Agreement shall be resolved via Arbitration under the auspices of the American Arbitration Association (AAA). The locale shall be the state of Texas. The arbitration shall be conducted by a single Arbitrator. The single Arbitrator will be demonstrably knowledgeable in the subject area of stored value card incentives and awards. The Arbitrator(s) shall apply the substantive law of the State of Texas, without regard to principles of conflicts of laws. The Arbitration will be conducted under the FORUM Code of Procedure for Resolving Consumer disputes. Each party will pay its own attorney’s fees. The Award shall contain a recitation of full findings of fact and conclusions of law. The Parties agree to keep confidential the proceedings, participants, documents and evidence and Award of, the arbitration, except as necessary to conduct the arbitration or in connection with any court application, related to the arbitration or as otherwise required by law.   THE PARTIES AGREE TO RESOLVE THEIR DISPUTE(S) ON AN INDIVIDUAL BASIS, AND EACH WAIVES THE RIGHT TO PARTICIPATE IN A CLASS, COLLECTIVE, PAGA, OR OTHER JOINT ACTION WITH RESPECT TO THE CLAIMS.
  4. VBI Financial Services or MEI Finance reserve the right to change, modify or terminate the Program rules, offering, services, procedures, conditions, benefits, or rewards, at its sole discretion, with or, where  permitted by law or agreement, without notice.  These changes may affect the value of points already accumulated, service offerings, membership entitlements, rules or procedures to access Program reward and benefits, and the continued availability of Program rewards and benefits.  
  5. Participation in Automax Rewards and Extended Warranty benefits requires that you be an active CarCard Cardholder in Good Standing, where your card account has had purchase or deposit activity within the past 60 days and has no negative balance or account suspension for cardholder fraud or misuse, as defined in the CarCard Prepaid Visa Cardholder Agreement.  Participation in Automax Rewards and Extended Warranty benefits requires you also to have an active MEI Finance auto loan balance or previous loan that is in Good Standing.  Good standing is defined as a MEI Finance loan that does not have a past due balance, is not in default, nor is subject to any judgments or previous write-off.  In the event your Program privileges have been suspended, corrective action to restore your MEI Loan or Card accounts to be in Good Standing will restore your Program privileges. 
  6. VBI reserves the right to suspend or discontinue Program privileges for any cardholder who appears to be  engaging in-- or VBI has reasonable grounds for suspecting of engaging  in --use of the Program in a manner inconsistent with the Terms and Conditions, the intent of the Program or any portion of the Program, or where:
    1. Breach or violation of the Program Terms and Conditions or the CarCard Visa Prepaid Cardholder Agreement by you has taken place.
    2. You have engaged in any fraudulent or dishonest behavior, theft, misconduct or wrongdoing in connection with the Cardholder account or Program benefits.
    3. You act or have acted in an abusive, inappropriate, offensive, fraudulent, or hostile manner; whether verbal, physical, or in writing; towards any VBI or VBI affiliate employees or contractors. 
  7. VBI at its sole discretion may waive certain rules of participation on a case by case basis, and if doing so the waiver does not constitute an obligation to do so in the future or for any other requirement under this or any Agreement. 
  8. Privacy and sharing of Information: The sharing of information among the parties involved in the operation of this Agreement (AutoMax, MEI Auto Finance Inc, and Entertainment.com) all shall abide by data safeguard regulations of the Federal Trade Commission and abide by all applicable commercial, credit, consumer,  and communication and privacy  protection and accuracy  rules and protocols required by federal and applicable state law, including but not limited to, the Fair Debt Collections Practices Act, the Electronic Communications Privacy Act, the Electronic Fund Transfer Act, the Telephone Consumer Protection Act, and the Consumer Credit Protection Act. 
  9.  You hereby permit, authorize and consent to AutoMax, MEI Finance, LLC. and Entertianment.com sharing information to the extent needed about you or from you so as to give effect to this Rewards and Benefits Agreement and also waive claims against and hold harmless those parties from any damages due to their good faith sharing of such information to give effect to this and related Agreements, 
  10. References to “loan”, auto loan”,” Financing” “Finance Account”, “payment obligations”, or “debt” etc. in this or any other Agreement or representation involving you & VBI Financial Services includes obligations and indebtedness incurred under a retail sales installment contract (RISC).

AutoMax Rewards Points

  1. AutoMax Points are earned in connection with your CarCard account activity and have redemption value at participating Dealers and MEI Finance.   Your point activity and available balance can be found within the CarCard mobile app Reward menu selection.   
  2. Earn and Accumulate AutoMax Points. Points will be earned and accrue on your account for the following activities:
    1. Earn 1 point for each dollar of Visa Signature Purchase spend.  To maximize your point earnings, select “Credit” on the point of sales device or request a “Credit” transaction when prompted by the cashier to ensure your purchase qualifies to earn AutoMax Points.  If you select “Debit” at the time of purchase or enter your Card PIN to complete a purchase transaction, the purchase will not qualify to earn AutoMax Points.  All other transactions including ATM, Teller withdrawals, reversals, merchant refunds, and cash unload transactions do not qualify to earn Automax Rewards points.  
    2. Earn 3 Points for each dollar of on-time MEI Finance Loan payments.  Qualifying payments must be initiated through the CarCard Application - My Car payment feature on or before the due date of MEI Finance loan payments.  
    3. VBI or MEI Finance at their sole discretion may offer periodic promotional point awards or opportunities to earn additional AutoMax points.  
  3. Redeem AutoMax Points: 
    1. Down Payment Awards – AutoMax Points are valued at $.03 per point when presented for down payment on a vehicle purchase at participating dealers. 
      1. Minimum points for such redemption is 5,000 points per redemption request.
      2. Maximum point redemption for Down Payment 150,000 points per vehicle.
    2. Loan Balance Awards – Points are valued at $.02 per point when redeemed for a Principal Balance payment.   Principal balance payment redemptions reduce the outstanding principal of your MEI Finance Loan balance.  You must continue to make your regularly scheduled payments, Loan Balance Award payments cannot be used to offset your regularly scheduled payment obligations.      
      1. Minimum point redemption is 25,000 points per redemption request.
      2. Maximum aggregate lifetime point redemption for each MEI Finance Loan is 150,000 points.
      3. Maximum of 1 redemption per MEI Finance loan account per calendar year
    3. Redemption procedures- To redeem points, cardholders will request a redemption from the sales manager at participating locations or service representative at MEI Finance.  
      1. Cardholder will indicate the type of redemption and the amount of points in the Automax redemption form provided, which may be captured electronically or in writing, or relayed to a service representative by calling 877-770-0027.   
      2. Each redemption request will be validated before qualifying towards the purchase of a vehicle or Loan Balance payment.  Approved point redemption request will be deducted from Cardholder’s point balance.
      3. The value of the redemption requests will be credited to the purchase amount.  For example: a 25,000 point Down Payment Award ($.03 X 25,000 points = $750.00) will be credited towards the financed purchase amount. 
      4. Cardholder cannot redeem point values greater than the purchase amount and must separately pay any required amounts greater than the redemption value at the time of sale.
      5. Automax point questions or disputes may be submitted in writing at to Rewards@carcard.com

  1. AutoMax points cannot be redeemed for cash and cannot be transferred or sold.  
  1. Forfeiture of Points- Cardholders with a lapse of account activity for a period of 180 days will forfeit all accrued AutoMax Points.  To keep accumulated points, cardholder must make one of the following actions to maintain CarCard account activities:
    1. Make a qualifying Visa Signature or Pin debit purchase.
    2. Deposit or load funds to your account balance.
    3. Make MEI Finance auto payments through the “My Car” feature within the CarCard mobile app.
  2. Cardholder is responsible for remaining knowledgeable as to the Program Terms and Conditions and the points accumulated in their account. We are not obligated to send notice of point forfeitures or Program changes.   

Discounts and Coupons 

  1. CarCard Discounts is an exclusive subscription-based membership offering that is provided at no cost as part of your CarCard account experience.   CarCard Discounts are fulfilled through Entertainment.com, a provider of promotional discounts at merchant outlets that include restaurants, retail, online merchants, entertainment venues, travel related, and other merchants across the USA and Canada.  
  2. CarCard provides you access to: 
    1. Discounts Are promotional coupons from participating local and national merchants. Coupons are administered digitally and with print offers that are accessible from within the CarCard app.  There may be restrictions as to how and when coupons can be used at merchants, these may be disclosed within the coupon offering or in the terms of use presented by Entertainment.com. 
    2. VBI assumes no liability for, and Cardholder agrees to hold VBI harmless for, any omissions, failures, service deliveries or services interruptions that arise from the CarCard Discounts or Coupon offers provides by Entertainment.com its affiliates, directors, agents, merchant participants, or assigns.   

 

Extended Limited Warranty Coverage

Vehicles that are financed by MEI Finance and that are purchased from participating dealers, may qualify for an extension of the Limited Warranty Coverage provided at the time of purchase. You may extend Warranty Coverage for up to 24 months or 24,000 miles from the time of your vehicle purchase, whichever comes first.  

To qualify for Extended Warranty Coverage:

Warranty Coverage is provided month to month, you must meet the CarCard qualifications and rules to receive continued warranty coverage. By failing to meet the qualifications and rules your warranty coverage is forfeit.  

Extended Limited Warranty Qualifications, Terms, and Rules: 

  1. Vehicle must be purchased from a participating dealer location on or following October 1, 2022.  (see a complete list of participating dealers locations below)
  2. You must have an active MEI Finance Account for the vehicle receiving Warranty Coverage
  3. Your MEI Finance account must be in good standing 
  4. Your CarCard account must be in good standing and without negative balance.
  5. You must meet the monthly deposit requirement of $1000.00 or greater within the first full month following the purchase of your vehicle.
  6. You must deposit $1000.00 dollars or more each month to receive warranty coverage in the calendar months following the initial month after vehicle purchase
  7. The deposit requirement must be met each month, without exception, through the term of the extended warranty period, otherwise your warranty coverage is forfeit immediately upon your failure to meet the monthly deposit requirement.

VBI is not obligated to provide notice when your Warranty Coverage is at risk of revocation or forfeit.   

This Warranty Extension is offered in connection with participating Dealers and MEI Finance, it extends, to the extent described, and within the terms set forth, in this Agreement below, the Limited Warranty provided to you at the time of your vehicle purchase.  The following Dealers Locations participate in the CarCard Extended Limited Warranty Coverage:

CarCard Extended Limited Warranty is serviced and administered by the participating Dealer named on the Limited Warranty provided with the purchase of your vehicle.  All warranty claims have a $100 deductible that is payable to the Dealer. By participating in the Extended Limited Warranty, you agree to the Dealer Extended Limited Warranty Terms and Conditions. These terms and conditions are set forth below, and are the full and exclusive terms of the Extended Limited Warranty, notwithstanding any other or prior agreements, warranties, offers or practices, any and all of which are merged in this statement of Terms and Conditions:

EXTENDED LIMITED WARRANTY Terms and Conditions

 

The Extended Limited Warranty offered through MEI Inc. and Carcard will cover repair or replacement of the below listed covered components/parts, which fail to perform their intended purpose, subject to all other terms and conditions of this limited warranty.  All repair or replacement of covered components/parts must be performed by Dealer or at the direction of with prior approval of Dealer.   The CarCard Extended Limited Warranty covers the components of the motor vehicle listed below on the terms set forth:                                                                                                               

WHAT IS COVERED                                                                                                    

I. Covered Components/Parts:  The following internally lubricated parts are covered, subject to the exclusions set forth in this limited warranty.                                                                            

a.  Engine:   Crankshaft and bearings, oil pump, internal timing gears or chain, camshafts, camshaft bearings, valve lifters, rocker arm assemblies and push rods, valve guides, pistons and rings, wrist pins, cylinders, gaskets and oil seals when replaced during repairs, connecting rods, distributor drive gear, all internal components of and including engine block and cylinder heads, if damage is caused by mechanical failure of an internally lubricated part other than overheating or freezing.                                                                                                                                                       

b.  Transmission:   The internal components of the automatic transmission or manual transmission.  The manual Transmission case and automatic transmission case and torque converter are covered if damaged by the failure of an internally lubricated part.                                                                                                                          

c.  Drive Axle Assembly Components (Rear):  Drive axle housing including: pinion bearings, side carrier bearings, ring and pinion gears, carrier assembly thrust washers, axles, axle bearings, internal trans-axle seal, and drive axle housing, if damaged by the failure of an internally lubricated part.                                                                                                                         

d.  Trans-axle Assembly:  Trans-axle housing, ring and pinion gears, drive chain, drive chain gears, carriers bearings, bushings, and internal seals, if damaged by the failure of an internally lubricated part.

This limited warranty does not cover repair for gradual reduction in operating performance due to normal wear and tear.   Replacement may be made with like kind and quality including using "rebuilt" or "used" components/parts.

II.  Labor:   All labor for covered repairs when performed by Dealer, or at the direction of or with prior approval of Dealer.

III.  Towing:   Dealer will reimburse purchaser for the actual expense, up to $50.00, of towing the vehicle to Dealer's service department at 1911 E Division St, Arlington, TX 76011, or to a repair facility designated by Dealer, provided that the cause of the breakdown was the failure of a covered component/part.  Towing expenses in excess of $50.00 per coverage breakdown are not covered under this limited warranty.

IV.  Substitute Transportation:  Dealer will not provide a rental vehicle or reimburse for rental vehicle charges.   There is no "Loaner" vehicle available for any repair.                                                                                                                                             

WHAT IS NOT COVERED                                                                            

This limited warranty does not cover the following:                                                                                     

1.  Loss caused by lack of required maintenance, servicing, negligence, misuse or abuse, or the lack or contamination of coolants, lubricants and refrigerants or any loss caused by overheating.

2.  Repairs and/or replacement without prior authorization by Dealer, or to any mechanical alteration not recommended by the vehicle manufacturer.

3.  Loss or expense for adjustments, tune-up, alignments, road service, collision or impact storage, maintenance items (such as lubricants, coolants, thermostats, filters, hoses, clamps, belts, spark plugs), nor any components/parts not listed in covered component/parts.                                                                                                                                             

4.  Loss to a covered component/part when damaged by failure of a non-covered part.

5.  Normal wear and tear in the absence of a mechanical breakdown necessitating replacement of the involved part (such as resurfacing heads, valves, valve seals, or replacing rings to raise engine compression).

6.  Loss covered by any other service agreement or warranty, including manufacturer recalls.

7.  Replacement of seals and gaskets except when required in conjunction with repair or replacement of covered components/parts, nor any subsequent damage to covered components/parts caused by operating the vehicle with leaking or faulty seals or gaskets. 

8.  Repairs required as a result of hauling trailer or other vehicles in excess of rate capacity, or without suitable equipment, or failure to follow the vehicle manufacturer's requirements as applicable.

9.  Any vehicle on which the odometer is inoperative or mileage has been altered and/or the actual mileage cannot be readily determined.

10.  Any vehicle if it has been used for competitive driving or racing, for commercial livery or delivery purposes, or off-road recreational purposes.

11.  Loss occurring while operating the vehicle outside the contiguous United States, Alaska, Hawaii and Canada.        

12.  Repairs necessary to maintain vehicle in compliance with local, state, or federal emission standards or tests.           

13.  Replacement of air conditioning systems or retrofitting with new equipment to meet requirements made by changes in the law. 

14.  Turbo-chargers and turbo-charged engines are not covered.                

MISCELLANEOUS TERMS                                                                                                         

Vehicle must be currently financed through an MEI Finance account. The failure of buyer to be current on all obligations under the Motor Vehicle Retail Installment Contract, including payments and required insurance coverage, will invalidate this limited warranty.  

Upon termination of this limited warranty, Seller shall have no further liability for any implied warranty, including any implied warranty of merchantability or fitness, and Dealer shall at no time have any liability for consequential damages of any sort or nature, but this limitation of liability shall not extend to those types of consequential damages the limitation of which is made unconscionable by statute.                                                                                                                                     

This limited warranty is extended solely and exclusively to the Buyer named on the Dealer Limited Agreement provided at the time of purchase, and shall be terminated by Buyer's sales or transfer of the described motor vehicle to any other person.                                                                                                            

Some states do not allow limitations on how long an implied warranty lasts, so the above limitation may not apply to either.                                                                                                     

Some states do not allow the exclusion or limitation of incidental or consequential damages, so the above limitation or exclusion may not apply to you.                                                                        

This warranty gives you specific legal rights, and you may also have other rights which vary from state to state.         

This Limited Warranty shall constitute the sole and complete agreement regarding any warranty, express or implied, between CarCard, Dealer and Cardholder.  No oral representation of any nature has been made which differs from the foregoing terms and conditions, and no modification of the foregoing terms and conditions shall be valid unless it is written and signed by both parties.

A deductible of $100.00 will be payable to Dealer Service Center for each claim visit.
